End-User License Agreement ("Agreement") Last updated: 2023/10/02 Copyright © LieberLieber Software GmbH. All Rights Reserved. Please read this End-User License Agreement ("Agreement") carefully before clicking the "I Agree" button, downloading or using LieberLieber LemonTree © 4.0 ("Application"). By clicking the "I Agree" button, downloading or using the Application, you are agreeing to be bound by the terms and conditions of this Agreement. If you do not agree to the terms of this Agreement, do not click on the "I Agree" button and do not download or use the Application. License LieberLieber Software GmbH grants you a revocable, non-exclusive, non-transferable, limited license to download, install and use the Application strictly in accordance with the terms of this Agreement. The desktop license of LemonTree allows running this software on personal computers only. Running the software on a server (e.g., buildserver) is not allowed. Please contact the team of LieberLieber via sales@lieberlieber.com and inform yourself about the server-based edition (LemonTree Automation). Evaluation License The Trial Edition of the LemonTree © is not free software. Subject to the terms of this agreement, you are hereby licensed to use this software for evaluation purposes without charge for a period of thirty (30) days. Upon expiration of the thirty (30) days, the Application must be removed from the computer. Unregistered use of the LemonTree © after the 30-day evaluation period is in violation of European, U.S. and international copyright laws. LieberLieber may extend the evaluation period on request and at their discretion. Restrictions You agree not to, and you will not permit others to license, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose or otherwise commercially exploit the Application or make the Application available to any third party. License Hosting In case of hosting the license keys by LieberLieber, the following user data will be stored in the log files: (i) user name and (ii) host name. The hosting servers are operated by a third-party provider. You are responsible for all activities that occur under your account. You will: (a) use commercially reasonable efforts to prevent unauthorized access to, or use of and notify LieberLieber promptly of any such unauthorized use; (b) comply with all applicable laws and regulations in using the service, including but not limited to those related to data privacy, international communications, and the transmission of technical data; (c) use LemonTree only for lawful purposes and only in accordance with this Agreement. Except as expressly authorized herein, you shall not cause or permit any distribution, disclosure, marketing, rental, leasing, or transfer to any third party access to LemonTree. LieberLieber’s hosting partner uses commercially reasonable efforts to make the hosting service available 24 hours a day, 7 days a week. You acknowledge that 24/7 Service Levels may not be available as a result of: (a) planned downtimes; (b) factors caused by circumstances beyond the reasonable control, including but not limited to, acts of God, acts of government, floods, fires, earthquakes, civil unrest, acts of terror, strikes or other labor problems (other than those involving LieberLieber employees or employees of LieberLieber’s hosting partner), Internet service provider failures or delays, power outages, or denial of service attacks; (c) issues caused by your or your end users’ actions or inactions; and (d) problems caused by your or end users’ third party hardware or software. LieberLieber shall give at least 8 hours’ notice of planned downtime via email to your central support contact. Any planned downtime will be scheduled, to the extent practicable, during the weekend. Modifications to Application LieberLieber Software GmbH reserves the right to modify, suspend or discontinue, temporarily or permanently, the Application or any service to which it connects, with or without notice and without liability to you. Term and Termination This Agreement shall remain in effect until terminated by you or LieberLieber Software GmbH. LieberLieber Software GmbH may, in its sole discretion, at any time and for any or no reason, suspend or terminate this Agreement with or without prior notice. This Agreement will terminate immediately, without prior notice from LieberLieber Software GmbH, in the event that you fail to comply with any provision of this Agreement. You may also terminate this Agreement by deleting the Application and all copies thereof from all devices. Upon termination of this Agreement, you shall cease all use of the Application and delete all copies of the Application. Severability If any provision of this Agreement is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect. Amendments to this Agreement LieberLieber Software GmbH reserves the right, at its sole discretion, to modify or replace this Agreement at any time.
